The US Supreme Court has ruled that the Affordable Care Act (ACA), the health care reform measure passed by Congress in 2010 over fierce opposition from Republicans and the Tea Party, is LEGAL! Voting to uphold the basic structure of the law were Chief Justice John Roberts and Justices Ginsberg, Breyer, Sotomayor, and Kagan. Voting to have the law ruled unconstitutional were Justices Scalia, Thomas, Kennedy and Alito. The Supreme Court voted 5 to 4 that the controversial individual mandate required in the law, the provision that requires every American to have health insurance is legal, under Congress’ power to tax. In other words if you don’t get insurance, you’d pay a tax penalty. The Court ruled 6 to 3 that the basic provisions of the law were legal. The Court, though ruled that a requirement of the law that would allowed the federal government to restrict money to states in the Medicaid program is unconstitutional. Bottom Line: The provisions of the Affordable Care Act, including no denial because of pre-existing conditions, help for seniors with the “donut hole” in medicines, covering your kids up to age 26 on your health insurance, all that and more has been ruled legal.
